Bonneville County, Idaho Arrest Search

Bonneville County arrest records can generally be accessed at the county level through the Bonneville County Sheriff's Office and at the state level through the Idaho State Police. The Sheriff's Office only tracks and maintains local arrest records, but the Idaho State Police maintains statewide arrest records through its Bureau of Criminal Identification. Obtaining a record from the State Police typically provides a more comprehensive history of an individual's interaction with the criminal justice system.

A criminal history record can be retrieved through a fingerprint or name-based background check. To perform a fingerprint check, interested persons may submit a completed Fingerprint-Based Criminal Background Check Form, a fingerprinted Applicant Fingerprint Card, a Payment Authorization Form, and a $25 payment to the department. For a name-based search, individuals may submit the Name-Based Criminal Background Check Form, along with the Payment Authorization Form, and a $20 fee.

Criminal history records may also be obtained from the Federal Bureau of Investigation (FBI). The FBI's data encompasses an individual's arrests from all states. However, unlike Idaho, individuals can only request their own record. Requests for one's criminal history record from the FBI can be made online, through an approved channeler, or via mail.

Active Warrant Search in Bonneville County

An arrest warrant is a binding judicial order demanding that law enforcement arrest and take an individual into custody. Arrest warrants in Bonneville County are granted by Magistrate or District Court judges when law enforcement submits a complaint revealing an investigation that demonstrates probable cause that an offense took place and that the suspect committed it (Idaho Criminal Rule 4). In some cases, especially for low-profile offenses, the judge may issue a summons rather than a warrant if they believe the suspect has no incentive to disobey the summons.

The following factors are usually considered when choosing between issuing a summons or a warrant.

  • The residence of the suspect
  • The suspect's employment status and the nature of work
  • The suspect's domestic relationships
  • The suspect's legal history and criminal record
  • The nature of the offense

A warrant generally details the suspect's name, a clear description of the offense charged, the command to arrest the individual, and the judge's signature.

The Bonneville County Sheriff's Office is primarily responsible for receiving, executing, and returning such executed warrants to the court. Individuals can call the Sheriff's Office to inquire about an active warrant in the county. Researchers may also visit the office to inquire in person; however, they may be arrested if they are making a self-inquiry and a warrant is found in their name. The Sheriff's Office explicitly warns citizens about the Fake Warrant Scam to never pay money over the phone or by text to resolve a warrant.

The Sheriff's Office does not offer an online lookup tool for searching active warrants. However, researchers can search an individual's court case record on the iCourt Portal to verify if there's an active warrant on their record.

Bonneville County Arrest Report

An arrest record and an arrest report are two different documents maintained by law enforcement agencies in Bonneville County. An arrest record is a summary of the apprehension and booking event, containing basic demographic details, the charges, the location, and the date of the arrest. On the other hand, an arrest report is a more detailed narrative written by the arresting officer, containing the officer's observations, evidence collected at the scene, how the arrest took place, and any hurdles encountered.

Interested persons can request an arrest report by submitting a request on the Bonneville County Public Records Request Portal. Requesters should be as specific as possible when providing the details of the record they need.

How to Get an Arrest Record Expunged in Bonneville County

In Idaho, the law makes provisions for the expungement, sealing, and shielding of certain records. An expungement erases and destroys a record from the file; sealing locks the file, but does not delete it; while shielding blocks the file from being accessible through online databases, like the Idaho iCourt Portal. However, only expungement directly relates to arrest records in the state. Sealing primarily covers judicial records, while shielding applies to public-facing court conviction records.

Idaho Code § 67-3004 is the primary law governing the expungement of arrest records in Bonneville County. To be eligible for expungement, individuals must have been found not guilty of the offense, or the prosecutor must have failed to file charges within one year of the arrest. Individuals seeking to expunge their arrest record may fill out and read the instructions on the Expungement Application Form and mail it to the Idaho State Police.

Idaho Court Administrative Rule 32 (I.C.A.R. 32) oversees the sealing of court records, including criminal records that may contain arrest information. There is no set-in-stone eligibility criteria for sealing. Individuals who want their records sealed may petition the court; however, they will have to prove to the court that their personal interest in privacy outweighs the public's right to know.

The Idaho Clean Slate Act is the law that allows individuals who were convicted in the state to shield their records from the public. A person can apply for their records to be shielded if

  • It has been at least five years since they completed their sentence, including probation, parole, restitution, and court fines;
  • They have no pending criminal cases, active restraining orders, or subsequent convictions during the five-year window; and
  • The conviction did not stem from a violent or sexual crime.

To shield a record, individuals may complete the Petition Form and follow the court's instructions.

How Do You Remove Bonneville County Arrest Records From the Internet?

Arrest records on the internet are generally published by government agencies or private websites. Removing an arrest record from a government website is relatively easier, as an individual only needs to obtain an expungement order from the court. Once the order is issued, the court communicates it to all government agencies that may hold the record, and the record is then redacted or deleted from the agency's public databases.

Removing an arrest record from private websites is a little less straightforward, as the court does not communicate an order of expungement to an agency not owned by the government. As such, individuals who want to remove a record that has been expunged, sealed, or shielded from a private website will have to take extra steps. This can include

  • Contacting the company using the contact data usually found on their website.
  • Requesting a de-indexing from search engines of the particular link that hosts the information.
  • Patronizing companies that offer content removal services.
